»The Law of Death«: The book establishes a new field of law: the doctrine of dying and death, »legal thanatology«. All areas of law are considered together and brought into conversation with other sciences. It's about »the law against death« (homicide offenses in criminal and civil law), »the right to death« (euthanasia, suicide, assisted suicide, killing on request), »the law of death« (definition of death) and »the law of the dead« (status of the corpse, autopsy, transplantation, burial law, post-mortem personal rights, expropriation of the dead). Comprehensive criticism is supplemented by proposals for reform. Die Publikation begründet ein neues Rechtsgebiet: die Lehre von Sterben und Tod, die »juristische Thanatologie«. Straf-, Zivil-, Verwaltungs- und Verfassungsrecht werden zusammengedacht und in ein Gespräch mit anderen Wissenschaften gebracht, insbesondere der Philosophie. Es geht um »das Recht gegen den Tod« (Tötungsdelikte in Straf- und Zivilrecht), »das Recht auf den Tod« (Sterbehilfe, Suizid, Beihilfe zum Suizid, Tötung auf Verlangen), »das Recht des Todes« (Definition des Todes) und »das Recht der Toten« (Status des Leichnams, Obduktion, Transplantation, Bestattungsrecht, postmortales Persönlichkeitsrecht, Enteignung der Toten im Urheber-, Erb- und Erbschaftsteuerrecht). Am Ende zeigt sich ein eher düsteres Bild, in dem von den vielbeschworenen Werten Sicherheit, Autonomie, Würde und Pietät wenig übrigbleibt. Der Autor kritisiert die herrschende Praxis auf allen Gebieten und entwickelt zahlreiche Vorschläge, wie sich das Bild deutlich aufhellen ließe.
